1. Acceptance of Agreement

By accessing the BIGLOU'S OPTIMIZER website, creating a user account, or initiating the download of our executable software, you hereby represent that you have read, understood, and agreed to be bound by every clause within this Terms of Service agreement.

If you are using this software on behalf of another individual or entity, you represent that you have the authority to bind that entity to these terms. Failure to adhere to these terms will result in the immediate revocation of your license and permanent blacklisting from our services.

2. Scope of License

Personal Usage Only

BIGLOU grants you a non-exclusive, non-transferable license to use the software for personal, non-commercial system optimization. Redistribution of any file associated with BIGLOU'S is a felony violation of this agreement.

HWID Binding (Apex Tier)

Each Premium/Apex license is strictly bound to a single Hardware ID (HWID). Sharing your credentials to allow use on multiple machines will result in an automated account suspension.

3. Anti-Cracking & Security

We maintain a strict zero-tolerance policy regarding software integrity:

I. Forensic Analysis

Attempting to reverse-engineer, decompile, or disassemble the BIGLOU'S executable is strictly prohibited. This includes using tools like IDA Pro, OllyDbg, x64dbg, or .NET decompilers.

II. Network Tampering

The use of packet sniffers (Wireshark, Fiddler) or proxy tools to intercept communication between the software and our MongoDB servers is grounds for an immediate HWID ban.

III. Redistribution

Selling access to accounts, distributing "cracked" versions, or providing the software on third-party forums/marketplaces without written consent will result in legal action.

IV. Fraudulent Disputes

Opening a dispute or chargeback with a payment processor after receiving a license key will be treated as fraud, and the associated HWID will be blacklisted across our entire network.

4. Performance & Safety

BIGLOU'S OPTIMIZER modifies system-level settings, including the Windows Registry, background services, and hardware scheduling. While we strive to provide the safest tweaks:

Restore Point Requirement: Users must create a Windows Restore Point before applying any optimizations. BIGLOU is not responsible for data loss or OS corruption if the user fails to create a recovery path.
Hardware Stress: Optimization presets (especially Power Plans and GPU tweaks) may increase hardware clock speeds. You acknowledge that use of these presets is at your own risk.
Anti-Cheat Compatibility: BIGLOU'S SOFTWARE is designed to be compliant with EAC, BattlEye, and Vanguard. However, we cannot guarantee against changes in third-party game policies that may occur after software updates.

5. Billing & Refund Policy

The APEX TIER is a premium service. All payments are non-refundable once the license key has been delivered or assigned to your account.

DIGITAL NATURE NOTICE: Because BIGLOU provides digital software that is immediately accessible, we cannot "reclaim" the software once it is used. Therefore, ALL SALES ARE FINAL.

6. Data Retention

We collect and store your Username, Email, and Hardware ID for authentication and licensing purposes. This data is handled in accordance with our Privacy Policy. We reserve the right to store logs of system errors occurring within the application to improve software stability.

Ultimate Agreement

These terms constitute the entire agreement between you and BIGLOU. We reserve the right to modify these terms at any time without prior notice. Continuing to use the software after such changes means you accept the new terms.
